Terms of Service

By accessing or using Lincah (the "Service") at lincah.com, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service. "Facilitator" refers to registered account holders who create and manage sessions. "Participant" refers to anyone who joins a session without a registered account.

Lincah is a session-based agile facilitation platform that enables facilitators to create and run real-time collaborative sessions, including planning poker, retrospectives, prioritization exercises, and related facilitation workflows. The Service is designed for professional use in team and organizational settings. It is not a project management tool and does not maintain persistent project data.

To create and facilitate sessions, you must register for a Lincah account. You are responsible for: - Maintaining the confidentiality of your account credentials - All activity that occurs under your account - Ensuring your contact information remains accurate and up to date You may not use another person's account without their permission. You must notify us immediately at support@lincah.com if you suspect any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms or that have been inactive for an extended period.

Participants may join sessions via a 6-digit code or QR code provided by the facilitator without creating a Lincah account. By joining a session, participants agree to these Terms and our Privacy Policy as they apply to session data. Facilitators are responsible for ensuring that all participants have consented to session data collection prior to joining.

You agree not to use the Service to: - Upload or transmit any content that is unlawful, harmful, defamatory, abusive, or otherwise objectionable - Violate any applicable laws or regulations - Attempt to gain unauthorized access to any portion of the Service or its related systems - Interfere with or disrupt the integrity or performance of the Service - Use the Service to process personal data of individuals in a manner inconsistent with applicable privacy laws - Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service We reserve the right to suspend or terminate your access to the Service if you engage in any prohibited conduct.

You retain ownership of all content you upload to the Service, including backlog items, feature lists, and other session data. By uploading content, you grant us a limited, non-exclusive, royalty-free license to store, process, and transmit that content solely for the purpose of providing the Service to you. Session data — including participant responses and uploaded files — is automatically and permanently deleted 72 hours after a session is closed. You are responsible for downloading any results you wish to retain before the expiry window closes. We are not liable for data loss resulting from the expiry window.

The Service, including its design, code, trademarks, and all content created by Lincah and Prerana.id Team, is our exclusive property and is protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any portion of the Service without our express written consent.

The Service is currently offered as a free tier with the following default limitations: - Maximum 10 participants per session - Data retained for 72 hours after session close - Unlimited sessions (subject to fair use) We reserve the right to modify these limits, introduce paid tiers, or change pricing at any time with reasonable notice. If you are on a free tier and a paid tier is introduced, your free access will continue until we notify you otherwise.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, ANTIGRAVITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING LOSS OF DATA, LOSS OF REVENUE, OR LOSS OF PROFITS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

You agree to indemnify and hold harmless Prerana.id Team, its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, sending an email notification to your registered address. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Service.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Prerana.id Team is registered, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
